TRADEMARK LAWYERS TO PROTECT INTELLECTUAL PROPERTY Trademark law is aimed at protecting and enforcing the legal rights of individuals and companies with respect to the intellectual property that they have developed or otherwise acquired. When new ideas and concepts are invented and created, it is appropriate that the originator of these ideas or concepts takes lawful title to their commercial and non-commercial usage, however to achieve that objective it is to their benefit to properly register and protect the associated intellectual property rights, be it through trademarking, copyrighting and/or patenting the pertinent ideas and/or concepts. The Canada Trade-marks Act, R.S.C., 1985, c.T-13, defines a trademark in section 2 of the Act as "(a) a mark that is used by a person for the purpose of distinguishing or so as to distinguish wares or services manufactured, sold, leased, hired or performed by him from those manufactured, sold, leased, hired or performed by others, (b) a certification mark, (c) a distinguishing guise, or (d) a proposed trade-mark." As such trademarks provide an important legal tool for purposes of protecting your intellectual property rights in a given concept or name, such that it is too your commercial advantage to retain the legal services of an experienced trademark agent / lawyer that is registered with the Canadian Registrar of Trade-marks. It is critical that you legally protect your intellectual property rights, and where necessary, effect appropriate enforcement actions, such that your business' trademark or other intellectual property rights remain yours to profit from. Unfortunately, there are far too many unscrupulous individuals in today's society. This makes the significance of correctly registering your prospective trademark, with an experienced trademark lawyer / agent, the appropriate course of action. |
